As you know, U.S. law requires that companies only employ those who can legally work in the country. Regardless, there are still instances in which those who cannot legally work in the U.S. are hired with or without the employer’s knowledge.
Since 1996 employers have been using E-Verify, a program used to verify employment eligibility to guarantee compliance in this area. This requires employers to disclose personal information about their employees. Due to the high sensitivity of this process, an extensive set of security controls have been set in place to protect employee information. But with fraud and cyber crimes on the rise, security controls must constantly be updated and developed.
A new security measure has been developed and is to be effective as of January 1, 2015. It requires that all E-Verify transaction records more than ten years old be deleted from the system on an annual basis. In the event someone would like to keep record of his/her cases, E-Verify has created a Historic Records Report that must be downloaded before the end of the year. This report will only include transaction records for cases that are 10 or more years old.
Now that E-Verify will not be keeping records for employers to request as they need, it is highly encouraged that employers record the E-Verify case number on the corresponding I-9 and to retain the Historic Records Report with the corresponding I-9 form as well.
